5150 is the California Welfare and Institution Code which legally authorize the involuntary detainment of an adult in an inpatient psychiatric hospital. Duration of the involuntary hold is 72 hours. Statute: LPS Act.
Any person who intentionally violates the patient’s right to a hearing by writ of habeas corpus is guilty of a misdemeanor.
California recently rolled out legislation called AB 2275. This law is tied to 14th Amendment rights for persons on locked inpatient units against their will. ER personnel, not County LPS designated or highly trained to work with this population beyond 72 hours, now have the legal responsibility to do the following: 1) act as a court presenter; b) act as an educator in due process rights; c) act as a legal clerk.
